Marc Kirschner

For over 50 years, Marc has been a well-recognized restructuring and reorganization lawyer, court appointed bankruptcy trustee, investment professional and financial advisor in large, complex global bankruptcy cases.

Marc has been with the Firm 8 years having joined with the group from Goldin Associates. He founded and led the bankruptcy and reorganization group in the New York office of Jones Day from 1987 through 2001. Marc was an active participant in the development of bankruptcy and reorganization practice into an area that is global in scope and impacted many of the country’s largest companies. He specialized in complex bankruptcy litigation and reorganization, including the world-wide financial institution Committee in the Drexel Burnham Lambert Group, Inc.  chapter 11 case and the New York Daily News in its chapter 11 case, preserving  at the time one of New York’s treasured institutions. He also led the business practice group in the New York office and was a member of the Firm – wide Executive Committee.

After he retired from Jones Day, for 5 years he was MD, General Counsel and COO of 3 SEC registered investment advisors specializing in the purchase of distressed debt with a  strategy to take a controlling role.

Thereafter, Marc was appointed chapter 11 of Refco Capital Markets, the largest, most complex global financial services  case after Drexel and before Lehman. He also was  Refco’s Plan Administrator and Litigation Trustee  post confirmation. Many participants in the Refco case recognized the central role Marc played as chapter 11 Trustee in bringing the case  to a prompt conclusion.

He served as Litigation Trustee  for the Tribune Litigation Trust, Le Nature’s Bottling Company and  Yellowstone Mountain Club Litigation Trusts, and  currently is Litigation Trustee for Millennium Health, Nine West, Highland Capital Management, and Alpha Latam Management. He leads Teneo’s financial advisory services for the SEC appointed Receiver of Platinum Partners.

He has testified numerous times in support of contested settlements, restructurings and plans of reorganization, and was rebuttal expert witness  about the nature, scope and determination of claims  under bankruptcy law  for the ResCap Liquidating Trust.

He is the author or co-author of a number of significant articles on bankruptcy law and practice and was Chair, The Morning After: Coping with the Consequences of  Failed LBO/Leveraged Recap Transactions, American Bankruptcy Institute 20th Annual Northeast Bankruptcy Conference, Newport, Rhode Island, July 12-14, 2013.

Marc was a Member of the Washington Mutual Bank Liquidating Trust Advisory Board and Designee for its Special Litigation Committee, March 2012 to 2018; he was also a Director of Spectrum Brands Holdings Inc., a large publicly traded company,  and Member of its Audit Committee, Governance Committee, and Special Committee to Handle Corporate Acquisition Matters, 2010 to 2013.

Marc has a J.D., cum laude, degree from the University of Michigan Law School, and A.B. degree, with distinction in economics, Dartmouth College.

Marc is a Fellow of The American College of Bankruptcy.
